"Information Governance" (IG) is more than just a technology or business management buzzword. Good IG is fundamental to regulatory and legal compliance, privacy and security, intellectual property protection, eDiscovery, and efficient, cost-effective day-to-day business operations. The Sedona Conference’s Working Group 1 on Electronic Document Retention and Production recognized this fact from its inception, publishing the first edition of its Best Practice Guidelines & Commentary for Managing Information & Records in the Electronic Age way back in 2004, followed by a second edition in 2008. By 2014, the concepts of electronic records and information management had evolved and broadened, and Working Group 1 published the Commentary on Information Governance.
Since 2014, there have been significant advances in business information and communication technologies, with developments in cloud computing, the increased use of third-party apps, adoption of advanced data analytics, and continued exponential increases in data volumes and diversity. Also since 2014, there have been significant developments in the laws affecting information management, including the 2015 Amendments to the Federal Rules of Civil Procedure, the implementation of the General Data Protection Regulation in Europe, and the passage of the California Consumer Privacy Act and similar statutes and regulations nationwide.
Recently The Sedona Conference published, for public comment, a second edition of the Commentary on Information Governance. In the process of updating the IG commentary, Working Group 1 members recognized that the growing volumes of electronic data, and the potential costs, burdens, and legal liability that maintaining outdated data represent – against the backdrop of potential sanctions for spoliation – require a more detailed treatment of data disposition than simply a chapter within a larger work on IG. The result of this dialogue has been publication of a companion piece for public comment, the Principles and Commentary on Defensible Disposition.
In a unique 90-minute webinar, members of the drafting teams of BOTH publications will discuss the significant updates to the IG commentary, and zero in on the complex calculus of Defensible Disposition. Among the issues the panel will explore are:
