During this session on Remedies, the dialogue leaders intend to lead participants in a dialogue on the following:
- Extraterritorial reach of the patent statute, including lost profits and reasonable royalty awards
- Use of smallest saleable unit for royalty calculations, including the valuation of specific components or features of a larger product
- Damage enhancement and willfulness after Halo, including the “should have known” concept
- Conceptual underpinnings of “irreparable injury” and “public interest” for injunctive relief
