Ben Herbert
Ben is a partner in Kirkland & Ellis’ Intellectual Property Group. He has significant experience representing plaintiffs in trade secret misappropriation trials. Since 2019, he was a key member of three trial teams that secured more than $1.5 billion in jury verdicts in cases involving claims for misappropriation of trade secrets. His practice primarily focuses on litigation in Federal District Courts, where he has worked on and led teams for both plaintiffs and defendants litigating complex cases involving diverse technologies, including digital radios, medical devices, computer software and hardware, graphics processors, bitcoin mining, portable power generation, and satellite technology. Ben also has significant experience before the United States Court of Appeals for the Federal Circuit, where he clerked for Judge O’Malley, including drafting briefs and arguing before the court. |
